3. We are neither a ‘charity’, nor a ‘not-for profit’ organisation
3.1 We are neither a ‘charity’, nor a ‘not-for profit organisation’, nor do we enjoy the benefits of charitable status in any shape or form. Any and/or all donations or gifts you make to us are not qualifying charitable donations or gifts.
3.2 We are a private limited company with shareholders and a list of our shareholders can be accessed at the UK Companies House. We operate a commercial for-profit business enterprise. Profits generated by us are distributed to our shareholders and/or re-invested in our business to help achieve purposes and projects we deem necessary or deserving and such purposes and projects include reconstructing the original Teatro San Cassiano of 1637 to Venice, and with it creating a world-leading centre of excellence for the study and performance of Baroque opera.
3.3 Any and/or all decisions undertaken by us regarding our spending and/or allocation of funds shall be at our sole and absolute discretion and we will not enter into any correspondence with you and/or a third party regarding our decisions, projects and objectives.
4. Who can donate?
4.1 You must be 18 years of over to make a donation or gift to us. If you are under the age of 18, you must have the prior parental or legal guardian permission before making a donation or gift to us. If you make a donation or gift to us online, please ask permission from the bill payer before using our online payment facility at www.teatrosancassiano.it/en/support-us to make your donation or gift to us.
5. Online donations or gifts
5.1 You can make a donation or gift to us by going online to our Website at www.teatrosancassiano.it/en/support-us and following the instructions provided.
5.2 You can use Paypal. Donations or gifts made to us using the aforementioned methods are subject to the respective providers’ terms and conditions.
5.3 The amount of the donation or gift is entirely up to you and there is no limit on the amount of times you may make a donation or gift to us. The minimum donation or gift is £10 GBP/ 10 Euros and the maximum is £9,999 GBP / 9,999 Euros. 7.1 We will not refund money donated or gifted to us once they are made unless in our sole opinion, such donation or gift was made in error and we will decide the extent (if at all) such donation or gift will be refunded to you.
7.2 If you reasonably believe that you donated or gifted money to us in error, you will notify us immediately by emailing us at email@example.com explaining why you think there was an error. We may ask you questions to understand better why the error was made before we decide how to proceed.
8.1 You shall not (and/or procure, encourage, assist and/or facilitate a third party to) make a donation or gift that is (or may) constitute an offence under applicable laws and regulations including (but not limited to) terrorism laws, anti-money launderings laws, anti-bribery laws, and/or criminal laws.
8.2 We reserve any and/or all rights in our total and absolute discretion to reject and/or block donations or gifts you make to us for any reason whatsoever including (but not limited to) because we decide that in our absolute and total discretion (a) a donation or gift you make to us breaches clause 8.1 above and/or (b) it would unethical to for us to accept a donation or gift you make to us
8.3 If we decide in our total and absolute discretion that you have breached clause 8.1 above, we may take such action as we deem appropriate including (but not limited to):
- suspending or terminating your right to access and/or use our Website;
- taking legal action against you; and/or
- making a disclosure of information regarding your donation or gift to us to applicable law enforcements authorities and/or agencies as we deem necessary and/or required by applicable laws and regulations.

12.1 These Donation Terms constitute the entire agreement between you and us when it comes to the subject matter of these Donation Terms and supersede and replace any other prior and/or contemporaneous agreements applicable to the subject matter of these Donation Terms. There are no third party beneficiaries to these Donation Terms and the provisions of the U.K. Contracts (Rights of Third Parties) Act 1999 are hereby excluded. Any words following the terms ‘including’, ‘include’, ‘in particular’, ‘such as’, ‘for example’ or any similar expression shall be construed as illustrative and shall not limit the sense of the words, description, definition, phrase or term preceding those terms.
13.1 Any dispute and/or claim (including non-contractual disputes and/or claims) arising out of or in connection with these Donation Terms and/or their subject matter and/or formation shall be governed by and construed (in each case on an exclusive basis) in accordance with English law.
14.1 The English courts shall have exclusive jurisdiction to settle any dispute and/or claim (including non-contractual disputes and/or claims) arising out of and/or in connection with these Donation Terms, including their interpretation, construction, subject matter and/or formation without giving effect to any principles of conflicts of law, provided that we reserve our rights to take any action, bring a claim, institute proceedings and/or seek any remedies in any other courts of a competent jurisdiction or territory (including where you are based or from any territory in which any breach of these Donation Terms occurs) for any reason whatsoever including to enforce any and/or all of our rights and/or remedies (including, without limitation, our IP rights and/or remedies), nor shall the taking of action, bringing of a claim, instituting proceedings and/or seeking any remedies in any one or more jurisdictions preclude the taking of action, bringing of a claim, instituting proceedings and/or seeking any remedies in any other jurisdictions, whether concurrently or not, to the extent permitted by the law of such other jurisdiction.
